1. Who we are

1.1 This website is operated by ABN Australia Accounting Services Pty Ltd (ABN 18 647 607 850, ACN 647 607 850), trading under the registered business name ABNAustralia.com.au.

1.2 In these terms, ABN Australia, we, us and our mean ABN Australia Accounting Services Pty Ltd and, where the context requires, its related entities within the ABN Australia group. You and your mean the person or organisation accessing the website.

1.3 ABN Australia operates through more than one legal entity. Where you engage us for a service, the specific entity that contracts with you, provides that service and is responsible for it will be identified in the engagement letter or other written agreement for that service. Those engagement terms, not this website, govern that relationship (see clause 9).

2. The information on this website is general only

2.1 Unless we expressly state otherwise, all content on this website relates to the laws of Australia. The laws of Australia may differ from the laws that apply to you in your own jurisdiction.

2.2 The content on this website (including articles, guides, case studies, publications, tools and calculators) is general information only. It does not take account of your particular circumstances, objectives or needs.

2.3 You should not rely on the content of this website as a substitute for professional advice tailored to your situation. Before acting on anything you read here, obtain appropriate legal, tax, financial or other professional advice.

2.4 Using this website, or receiving information from it or from us, does not create a client relationship between you and ABN Australia. A client relationship arises only when we and you enter into a signed engagement letter or other written agreement for a specific service.

3.1 ABN Australia is not a law firm and does not provide legal advice in connection with its services or products. We are not liable for any failure by you or any other party to obtain appropriate legal advice in connection with our services or products.

3.2 We are not licensed to provide financial product advice and do not hold an Australian Financial Services Licence. Nothing on this website is, or should be taken to be, financial product advice or a recommendation to acquire or dispose of any financial product.

4. Tax agent services and complaints

4.1 The provision of tax agent services in Australia is governed by the Tax Agent Services Act 2009 (Cth) and its regulations (the TASA). In providing tax and BAS agent services, we must comply with the TASA, including its statutory Code of Professional Conduct (the Code), which comprises the ethical and professional standards that registered tax practitioners must observe.

4.2 We are a registered tax agent (registration number 26090360). As part of our obligations under the TASA and the Code, we confirm to clients to whom we provide tax or BAS agent services that:

  • The Tax Practitioners Board (the TPB) is responsible for registering and regulating tax practitioners in Australia and for ensuring compliance with the TASA. The TPB maintains a public register of tax agents and BAS agents, which you can search at: https://www.tpb.gov.au/public-register

  • If you have a complaint about our tax or BAS agent services, please raise it with us first and we will try to resolve it. If we cannot resolve it, you may lodge a complaint with the TPB. The TPB's complaints process is at https://www.tpb.gov.au/complaints and complaints can be lodged through its online form at https://myprofile.tpb.gov.au/complaints/

  • As a registered tax practitioner, we have rights, responsibilities and obligations (including to you) under the TASA, the Code and the taxation laws. These include upholding and promoting the ethical standards of the tax profession, acting honestly and with integrity, managing independence, maintaining confidentiality, and acting competently.

  • You also have obligations to us as your tax or BAS agent. These include being truthful in the information you give us, keeping the records you are required to keep and providing them to us in a timely way, cooperating with our requests and deadlines, and complying with the taxation laws.

4.3 Further information about our rights, responsibilities and obligations (including to you) is on the TPB's website at https://www.tpb.gov.au/code-professional-conduct. Information about your obligations is at https://www.tpb.gov.au/obligations. The TPB also publishes an Information for Clients factsheet summarising the obligations of both tax practitioners and taxpayers.

4.4 We confirm that:

  • none of the events prescribed under section 45(1)(d) of the Tax Agent Services (Code of Professional Conduct) Determination 2024 (Cth) have occurred during the relevant period; and

  • our registration as a tax or BAS agent is not subject to conditions.

5. Professional standards

We are members of professional accounting bodies and are bound by their by-laws and applicable professional and ethical standards, including the standards issued by the Accounting Professional & Ethical Standards Board (APESB). These standards apply to the professional services we provide under an engagement and operate alongside, and in addition to, our obligations under the TASA.

6. Intellectual property

6.1 Unless we state otherwise, all content on this website (including text, graphics, logos, guides, articles, publications, tools and their selection and arrangement) is owned by ABN Australia or its licensors and is protected by copyright and other intellectual property laws.

6.2 You may view, download and print content from this website for your own personal or internal business use. You must not otherwise copy, reproduce, republish, distribute, adapt, commercialise or create derivative works from any content without our prior written consent, except to the extent permitted by law.

6.3 "ABN Australia", our logos and our business names are our trade marks or registered business names. You must not use them without our prior written consent.

7. Acceptable use

When using this website, you must not:

  • use it in any way that breaches any law or regulation, or infringes anyone's rights;

  • attempt to gain unauthorised access to the website, its servers or any connected systems;

  • introduce any virus, malware or other harmful code, or otherwise interfere with the proper working of the website;

  • use any automated means (including scraping, harvesting or data mining) to access or extract content, except for legitimate search-engine indexing; or

  • use the website or its content to compete with us or to build a similar or competing service.

8. Links to other websites

8.1 This website may contain links to other websites operated by people other than ABN Australia (linked websites). These links are provided for convenience only and may not remain current or be maintained.

8.2 A link to a linked website is not an endorsement, approval or recommendation by us of that website or of any information, products or services on it. We are not responsible for the content or practices of any linked website.

9. If you are a client: your engagement governs

If you are, or become, a client of ABN Australia, the engagement letter or other written agreement for your service sets out the terms of that relationship. To the extent of any inconsistency between that engagement and these website terms, the engagement prevails for that relationship. Nothing in these terms limits or replaces the rights, responsibilities or obligations set out in your engagement, the TASA or the applicable professional standards. We cannot, and do not seek to, contract out of our statutory obligations under the TASA.

10. Privacy

Our handling of personal information is described in our Privacy Policy, available at https://abnaustralia.com.au/privacy-policy. By using this website, you acknowledge that we collect, use and disclose personal information in accordance with that policy.

11. Accuracy and availability

11.1 To the extent permitted by law, we do not warrant that the information on this website is accurate, reliable, complete or current. We take reasonable care in producing and collating it, but information may change at any time in ways that affect its accuracy or completeness, and content may be omitted.

11.2 We do not warrant that the website will be available without interruption, error-free, or free of viruses or other harmful components.

12. Liability

12.1 Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law, to the extent that it cannot lawfully be excluded, restricted or modified (non-excludable rights).

12.2 Subject to clause 12.1, and to the maximum extent permitted by law, we will not be liable to you for any direct, indirect, special or consequential loss or damage arising in any way out of your use of, or inability to use, this website or its content, including any loss or damage caused by the transmission of any virus or other harmful code.

12.3 Where our liability cannot be excluded but can be limited, our liability for a breach of a non-excludable right is limited, at our option, to:

  • in the case of services, resupplying the services or paying the cost of having the services resupplied; and

  • in the case of goods, replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.

12.4 This clause 12 does not apply to the professional services we provide to you under an engagement. Our liability for those services is governed by the engagement and by any scheme under Professional Standards Legislation that applies to us.

13. Changes to these terms

We may update these terms from time to time. The current version is the one published on this website. By continuing to use the website after we publish a change, you accept the updated terms. We recommend you review these terms periodically.

14. Compliance with law

Nothing in these terms limits our right to comply with any law, or with any request or requirement of a law enforcement agency or government authority, relating to your use of this website or to any information provided to, or gathered by, us in connection with that use.

15. Governing law

These terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia and the courts that hear appeals from them.

16. General

16.1 If any part of these terms is found to be invalid or unenforceable, that part is severed and the rest of the terms continue to apply.

16.2 If we do not enforce a right under these terms, that is not a waiver of that right.

16.3 These terms, together with our Privacy Policy and any engagement you have with us, set out the entire basis on which you use this website.
