Payday Super Regulations confirm 3-day processing rule from 1 July 2026

The Australian Taxation Office (ATO) has released the final Payday Super Regulations, providing key operational details ahead of the system’s commencement on 1 July 2026.

The regulations confirm that superannuation funds will be required to allocate or return employer contributions within three business days, a significant reduction from the current 20-day timeframe. This change is designed to ensure employee superannuation payments reach funds within the required seven-business-day processing window under the Payday Super framework.

The regulations also clarify which payments are excluded from “qualifying earnings” and therefore do not attract superannuation guarantee obligations. In addition, they outline adjustments to the administrative uplift component used in calculating the Super Guarantee Charge, which may be reduced under the new rules.

With less than three months until implementation, the ATO is urging businesses to take immediate preparatory steps, including reviewing payroll systems, updating employee superannuation records, and reassessing cash flow processes to accommodate the accelerated payment cycle.
