ASIC to ease compliance while stepping up enforcement

ASIC will streamline compliance for businesses while increasing scrutiny of misconduct under its 2026-2027 Corporate Plan, with foreign-owned companies operating in Australia also facing closer regulatory oversight.

ASIC said it will prioritise clearer, simpler regulatory guidance and instruments, improved digital services and more efficient licensing processes, while strengthening supervision and enforcement against businesses that cause harm. It will also coordinate more closely with other regulators on data collection. 

For foreign-owned Australian companies, the changes reinforce the need to maintain effective local compliance arrangements and respond promptly to ASIC requirements. Businesses operating through Australian subsidiaries, branches or other structures should ensure their corporate records, regulatory obligations and dealings with ASIC remain up to date. Easier access to regulatory processes does not mean reduced compliance expectations. 

ASIC Chair Sarah Court said the regulator aims to reduce unnecessary regulatory friction for businesses seeking to comply, while making it more difficult for those engaging in misconduct to avoid scrutiny. 

The plan identifies consumer harm, scams, debt collection, insurance claims intermediaries, buy now pay later services and superannuation advice as key areas for regulatory attention. 

ASIC will also expand its focus on artificial intelligence, including the use of AI by financial institutions, potential effects on consumers and investors, and risks arising from deepfakes, misinformation and AI-driven market manipulation. 

At the same time, ASIC plans to strengthen supervision of managed investment schemes, improve market integrity across public and private markets, and expand its capabilities in data, intelligence, AI and cybersecurity.
