Understanding the benefits of trademark registration
Did you know that registering your company name, business name, or domain name is not the same as trademarking it? The differences between company names, business names, domain names, and trademarks sometimes causes confusion. Company name holders often think that by registering a company name or business name with ASIC they have protected a brand or trading name – whereas in fact the business names laws that exist today do not offer that type of protection. The obligation to register a company or business name is separate to protecting any intellectual property rights in a name or brand normally achieved through trademark registration.

A company name or business name does not give you exclusive trading rights or ownership over that name. Registering a particular name with ASIC does not stop another person from registering a similar name. It also does not give you the exclusive right to use the name or part of the name. Importantly, registering a business name will not stop someone who has registered the name as a trademark from using it. In fact, the opposite is more likely in that using a business name that is similar to someone else’s registered trade mark could cause you legal problems - they may be able to legally enforce you to stop using your business name in the marketplace.

This is why you should always conduct a trade mark search before deciding on a business name to ensure there is no clash, and also protect your brand name in the marketplace by registering your own trademark.
